Terms of Use
Version of September 3, 2026 · applies to the Lumenglows app (Lumenglows) · English translation; the German version is the authoritative one
1. Scope and provider
These Terms of Use govern the use of the app Lumenglows (in the App Store: Lumenglows) and of the paid offering Lumenglows Plus. The provider of the app is:
Philippe FroehlySchupfarterstrasse 6
5074 Eiken
Switzerland
Email: hallo@lumenglows.com
The provider is a natural person and not a business entered in the commercial register. Further details are in the Legal Notice.
By downloading and using the app, these terms are accepted. Any conflicting terms proposed by the user do not apply.
2. Subject matter
Lumenglows provides wallpapers (“images”) for iPhone and iPad. The images are contained in the app and are not loaded from the network. Part of the catalog can be used without payment; the remaining part is part of Lumenglows Plus.
Lumenglows is offered as an automatically renewing subscription. Four wallpapers are free of charge for good; the subscription opens the full catalog. The purchase screen in the app shows the price and the term before the purchase.
The images are created using generative image processes. No particular image content, image style or particular number of images is warranted.
Use requires a device that meets the technical requirements of the app (iPhone and iPad running iOS 18 or iPadOS 18 or later) and, for purchases, an Apple Account.
3. Conclusion of contract and handling by Apple
The app and all in-app purchases are obtained exclusively through Apple’s App Store. Two separate relationships arise from this:
- The contract of sale for the app and for Lumenglows Plus is concluded with Apple. The seller and contracting party is Apple Distribution International Ltd., Hollyhill Industrial Estate, Hollyhill, Cork, Ireland. Apple’s terms and conditions for the App Store apply in addition.
- The relationship of use in respect of the app and the images is governed by these terms and exists with the provider.
The provider is therefore not the recipient of payment and receives from Apple neither means of payment nor billing data of customers.
4. Prices and payment
The prices shown in the App Store or in the app’s purchase screen apply, in the respective local currency and in each case including statutory taxes and levies. This page deliberately names no amounts: prices can change, and the price shown immediately before the purchase is always the binding one.
Payment is made using the payment method stored with the Apple Account. Billing is handled by Apple.
5. Term, automatic renewal and cancellation
A subscription renews automatically for the same term, at the price then applicable, unless it is canceled at the latest 24 hours before the end of the current period. The charge is made within the last 24 hours before the end of the period.
Cancellation is done in the Apple Account settings on the device and is possible at any time without giving reasons. Access remains in place until the end of the period already paid for. The route to managing subscriptions is set out on the Support page.
Where a free trial period is granted first, it turns into a paid subscription unless canceled. Any unused part of a trial period lapses upon purchase of the same offering. Trial periods are granted by Apple per customer and are not available more than once.
6. Withdrawal and refunds
Since the contract of sale is concluded with Apple, withdrawal, unwinding of the contract and refunds are governed by Apple’s terms. Requests of this kind are to be addressed to Apple — usually via reportaproblem.apple.com or via the purchase receipt in the Apple Account.
Statutory rights of withdrawal of consumers, in particular under the law of the European Union, remain unaffected. The provider cannot refund any payments, because none are received; the provider will, however, assist with justified requests directed at Apple.
7. Right of use in the images
All images, texts, design elements and the logo are protected by copyright. All rights remain with the provider.
Use of the app grants a non-exclusive, non-transferable right that may not be sublicensed to use the images for private purposes — in particular as a wallpaper or Lock Screen on one’s own devices. For images already saved, the right is unlimited in time and unrestricted in territory.
The following in particular are not permitted:
- resale, rental, exchange or any other transfer of the images for consideration;
- further distribution or making available to the public, for instance in wallpaper collections, on websites, on social networks as a standalone offering, or in other apps;
- any commercial use, including use in advertising, on printed matter, on goods and in digital collectibles;
- use as training material for machine learning processes;
- removing or altering notices of authorship or origin, as well as extracting the image files from the app in order to circumvent paid content.
Editing for purely private use — cropping for one’s own device, for example — is permitted as long as the result is not passed on.
When a subscription ends, access to the paid images in the app ceases. Images already saved to the photo library are technically unaffected by this and may continue to be used privately within the scope of these terms.
8. Users’ obligations
The app may not be reverse-engineered, modified or circumvented, nor used in a way that impairs its operation or the protection of paid content, unless this is expressly permitted by law.
9. Availability and changes to the catalog
The app is provided without any assurance of a particular level of availability. Its core functions work without an internet connection; a connection to Apple’s services is required for purchases and for restoring them.
The provider may develop the catalog further, add to it and remove individual images, for legal or quality reasons for example. Likewise, the extent of the part that can be used free of charge may be adjusted. The essential scope of the service is preserved for any period already paid for.
The provider may discontinue the app and its offerings in the future. In that case, running subscriptions will not be renewed further.
10. Warranty
The statutory provisions on defects apply. The provider does not warrant that the app will be usable without interruption, free of errors or on every device configuration, and owes no particular number or kind of images.
Mandatory warranty rights of consumers remain unaffected.
11. Liability
The provider is liable without limitation for intent and gross negligence, as well as for injury to life, body and health and in all further cases of mandatory statutory liability.
In cases of slight negligence, the provider is liable only for breach of material contractual obligations, and then limited to the damage typically foreseeable at the time the contract was concluded. Otherwise liability is excluded to the extent the law permits.
For the loss of data, the provider is liable only to the extent that the damage would also have occurred had the user carried out proper and regular data backups.
Mandatory provisions of consumer protection law take precedence over this clause.
12. Changes to these terms
The provider may change these terms where this becomes necessary as a result of changes in the law, in case law, in Apple’s requirements or in the range of services offered. The version applicable at any given time is available at https://lumenglows.com/agb/ and carries a date at the top. Material changes affecting a running subscription will be announced in the app.
13. Governing law and jurisdiction
Swiss law applies, to the exclusion of the United Nations Convention on Contracts for the International Sale of Goods (CISG) and to the exclusion of conflict-of-law rules.
An important limitation in favor of consumers: anyone using the app as a consumer retains the protection of the mandatory provisions of the law of the state in which they have their habitual residence. This choice of law does not deprive them of that protection.
To the extent legally permissible, the courts at the provider’s domicile in Switzerland have jurisdiction. Consumers may in addition bring proceedings against the provider at their own place of residence, insofar as the mandatory provisions applicable to them so allow.
The provider is neither obliged nor willing to take part in dispute resolution proceedings before a consumer dispute resolution body. Complaints about a purchase are to be addressed to Apple as the seller (see section 6).
14. Final provisions
Should any provision of these terms be or become invalid, the validity of the remaining provisions remains unaffected. The statutory rule takes the place of the invalid provision.
The contract language and the language of these terms is German. Questions about these terms: hallo@lumenglows.com.
